Terms & Conditions

By ordering from Gabriella Grace Cakes you agree to be legally bound by these Terms and Conditions. The Terms and Conditions may be modified or amended from time to time and will be available to view on http://www.gabriellagracecakes.co.uk/.

1. Payment and Deposit

The price for the order shall be as stated on your invoice. We require a 50% non-refundable deposit to confirm an order and hold the date. Any deposit paid is deducted from the overall balance. The remaining 50% is due one calendar month before the delivery date, at which point all changes must be confirmed. Any changes to the previously agreed design may incur an extra charge.

Orders placed less than 4 weeks in advance of the delivery date must be paid in full. The final balance specified on the invoice must be paid by you 4 weeks before the delivery date. Payment can be made earlier if you wish. Failure to complete payment 4 weeks before the delivery date may result in your order being cancelled and any outstanding balance will still be payable. By making a payment you are accepting the Terms and Conditions as detailed on this page.

2. Travel Expenses

Please note, there is a charge of £0.45 per mile from Gabriella Grace Cakes’ address (TS10 2JH) to and from your event venue for travel expenses. This charge is added onto your final invoice and is due with your final payment.

3. Quotations

All price quotations made to you in writing are valid for 30 days from the date of quotation.

3. Wedding Cake Consultations

Consultations are by appointment only and are not applicable to all orders. An appointment for a consultation must be agreed with Gabriella Grace Cakes by email and a non-refundable consultation fee of £20 must be paid prior to consultation date before it can be confirmed. If following a consultation you choose to book with Gabriella Grace Cakes, the consultation fee will be deducted from your final balance. All appointments for consultations will be confirmed in writing by Gabriella Grace Cakes.

All consultations are to take place at 16 Goodwood Road, Redcar, unless alternative arrangements have been made and this will be discussed prior to the consultation. Without a consultation, we will not accept responsibility if the desired design does not meet expectations on the wedding day and a refund will not be offered. Prior notice of 5 working days must be given in you wish to cancel or reschedule an appointment. If you are unable to attend a consultation and have failed to give appropriate notice, you will be charged.

Gabriella Graces Cakes reserves the right to cancel a booking following a consultation, without the refund of a deposit, in circumstances where there is a conflict regarding design, approach, expectations and/or the client is uncooperative, not open to suggestions or makes a member of staff uncomfortable. In the event that you decide after your consultation that you are not satisfied, it is required you contact Gabriella Grace Cakes immediately to resolve the matter. Additional consultations or cancellations without charges are solely at Gabriella Grace Cakes’ discretion.

4. Alterations

If you have any queries or need to make any changes to an order please contact us immediately. Alterations and amendments must be submitted in writing. We will assess the request for an alteration, and endeavour to make alteration where possible dependant on the design and amount of notice given. We will let you know its effect on the price and any agreed timetable. Accepting any alterations is at the discretion of Gabriella Grace Cakes. It is the Buyer’s responsibility to check any quotes and invoices thoroughly before making payment. We reserve the right to change the design at any point if circumstances beyond our control compromise the quality of the finished product. e.g. weather conditions. The Buyer will be notified of any such changes and we will endeavour to keep any changes minimal.

5. Cake Stand Hire

Gabriella Grace Cakes offer cake stand hire. A £10 hire fee plus a refundable security deposit is required in advance. It is the Buyer’s responsibility to return the cake stand/s after hire to our address within 5 working days. The deposit will not be refunded in the event that the stand/s is/are damaged, or returned after 5 days. We are not liable for any damages that occur to the cake stand before we receive it back. Once the stand is returned within the given timeframe and we are satisfied that it is not damaged we will issue a refund to you. Please note, we do not provide cake tables, tablecloths or cutting knives. It is the responsibility of the buyer to provide these or check with the venue to ensure these items are provided.

6. Delivery and Collection

We cannot be held liable for any damages to the cake or products we have delivered once we have delivered or delivered and set up the cake at the agreed location and received a signature for the safe receipt on our delivery note. If the cake or products are collected from us, we cannot be held liable for any damages to the cake or products once they have left our premises. An approximate shelf life will be provided on the delivery/collection note. This is advisory only. Please note, once cakes have been cut into the shelf life will be reduced.

7. Delays

We will always endeavour to deliver within the given time slot, however unfortunately delivery timings cannot be guaranteed. Refunds will not be given for delayed deliveries. If in the unlikely event the delivery is delayed, we will always endeavour to deliver the cake to you as close as possible to the given delivery time. Gabriella Grace Cakes does not hold any responsibility for adverse weather conditions effecting access to any venue or delivery of orders. Gabriella Grace Cakes will attempt to get to the venue only when it is deemed safe. Gabriella Grace Cakes cannot be held responsible for ‘Acts of God’ (fire, flood etc) or any other unforeseeable circumstance that delay the delivery of the cake/products.

8. Damages

Gabriella Grace Cakes accepts no liability for cakes that are damaged after they have been delivered to the agreed location. For cakes delivered to venues, Gabriella Grace Cakes requires a signed delivery note by a member of the bridal party or a member of staff to say that the cake has arrived and that it has arrived in perfect condition. Cakes collected from Gabriella Grace Cakes require a signed delivery note by the person collecting to say that the cake has been collected and that it has been collected in perfect condition. Damages after this point are not Gabriella Grace Cakes’ responsibility.

9. Samples and Illustrations

Where samples of cakes are shown to the buyer, the buyer hereby accepts that they consider such samples to be representative of the goods. Any description applied to the goods is only given by way of identification and does not constitute a sale by description. Any image provided as part of the description of similar goods is given for illustrative purposes only. Given the nature of the goods, minor variations of colour and design may occur.

10. Allergies and Special Dietary Requirements

Gabriella Grace Cakes is unable to cater to any allergies or special dietary requirements. Please discuss any allergies or special dietary requirements with us before making a payment. Please be aware that whilst your chosen cake may not be made with nuts or a nut product, egg, dairy wheat or gluten, It will be prepared in a kitchen where nut products, eggs, diary, wheat and gluten are used. Whilst every effort is made to separate raw materials, raw materials used in your cake may not be free from nuts, eggs dairy, wheat or gluten.

11. Non-edible Ingredients and Decorations

Most cakes contain small proportions of inedible items. It is the client’s responsibility to ensure these are removed by your caterer/guests before consumption e.g. support dowels in tiered cakes, ribbon, wires in sugar flowers, flower picks & flower tape etc. These will be detailed on the delivery note and must be removed before serving or eating.

From time to time some materials for our celebration cakes and wedding cakes may become obsolete or no longer available from our suppliers, for example, pre-manufactured items or ribbon colours. This is totally out of our control, though we will endeavour to re-design a cake to reflect as closely as possible the original design using replacement products. In all cases we will try to contact you to advise you of any such changes. However, Gabriella Grace Cakes reserves the right to replace these with components of equal or better quality without consultation.

12. Fresh Flowers

If you require fresh flowers, it is your responsibility to source the florist/flowers, unless specifically agreed with Gabriella Grace Cakes. It is the customer’s responsibility to ensure that any fresh flowers displayed on or next to the cake are food-safe. We recommend any fresh flowers be organic and provided by a florist who is qualified to advise on their toxicity. Please note Gabriella Grace Cakes cannot take responsibility for any contamination caused by the misuse of fresh flowers and/or any damage to the cake caused by a floral arrangement implemented by your florist.

13. Photography and Social Media

The photographs Gabriella Grace Cakes use are an accurate representation of our cakes however, as each cake is handmade, details may vary and colours may not be exactly as shown. We reserve the right to use photographs of orders on our website, blog, Instagram, Twitter, Pinterest and Facebook pages. If you would like to specifically request that we do not use photographs of your order, you must let us know at the time of ordering. We do not post images of orders until after the event. Gabriella Grace Cakes are happy for any order to be photographed however, any image incorporating an order posted on the internet or social media must make reference to or credit Gabriella Grace Cakes as the designer.

14. Refunds and Cancellations

Deposits are non-refundable and non-transferable under any circumstances due to loss of business arising from turning away other bookings on that date. We cannot refund the cost of any orders cancelled with less than 6 weeks notice. Orders paid in full and cancelled with more than 6 weeks notice will receive a partial refund of 50% of the total amount paid. If a client wishes to cancel their order, they must do so in writing, either by letter or email. The order is cancelled once Gabriella Grace Cakes has received the confirmation and responded to confirm so.

In the very unlikely event that we have to cancel your order for any reason (including death, injury, equipment failure, sickness, force majeure, acts of God or any other circumstances beyond our control) our liability shall be limited to a full refund of all payments made to date. If possible, every effort will be made to find an alternative provider on your behalf.

In the unlikely event of cancellation of this contract by either party, whether caused by negligence or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

15. Liability

The Company does not accept liability and shall not be liable for non-completion of any event or for any delays arising as a result of: strikes, riots or lock outs affecting any trade with which Gabriella Grace Cakes is concerned, exceptionally adverse weather conditions, loss, damage or cancellation due to fires, floods of any other cause beyond our reasonable control. The liability of Gabriella Grace Cakes in respect of all claims arising under any contract should be limited to the amounts of the price or charges payable to Gabriella Grace Cakes under such contracts.

16. Complaints

If you wish to make a complaint or let us know any concerns after receiving the goods, please do so in writing. Evidence of any faults, damages or discrepancies should be included. Any refunds will be given entirely at our discretion.
